{"id":6572,"date":"2021-03-18T10:00:06","date_gmt":"2021-03-18T10:00:06","guid":{"rendered":"https:\/\/fraternity-sy.org\/?p=6572"},"modified":"2021-03-18T10:00:06","modified_gmt":"2021-03-18T10:00:06","slug":"ffhr-presented-a-policy-paper-on-adanss-law-of-the-associations-in-the-northern-syria","status":"publish","type":"post","link":"https:\/\/fraternity-sy.org\/ar\/ffhr-presented-a-policy-paper-on-adanss-law-of-the-associations-in-the-northern-syria\/","title":{"rendered":"FFHR presented a policy paper on ADANS\u2019s law of the associations in the Northern Syria"},"content":{"rendered":"<p dir=\"ltr\" style=\"direction: ltr;\">The legislative council of the Autonomous Democratic Administration of Northern Syria (ADANS) in dialogue with our colleagues on legislation and the associations\u2019 law.<\/p>\n<div dir=\"ltr\">With a view to open a dialogue between authorities and citizens and to promote political participation and democratic practices, Fraternity Foundation for Human Rights (FFHR) \u2013 on Tuesday, October 13, 2018 in Qamishli city \u2013 held a dialogue session on legislation, enactment of new laws and associations\u2019 law. The dialogue session was attended by Mr. Hakam Khalo, the joint chairman of the Legislative Council of ADANS; Perwin Abdel Fattah, representative FFHR; Mrs. Khadija Ibrahim joint president of lawyers\u2019 Union in Al-Jazira Region.<\/div>\n<div dir=\"ltr\"><\/div>\n<div dir=\"ltr\">Mr Khalo spoke about the conditions surrounding the establishment of ADANS and its institutions including the Legislative Council. He also addressed the issue of enacting laws and the problems facing the implementation of these laws.He valued the importance of organizing such dialogues with citizens and the need to be open to constructive criticism of ADANS.<\/div>\n<div dir=\"ltr\"><\/div>\n<div dir=\"ltr\">For her part, Mrs. Khadija Ibrahim talked about the letter of the law and its touched implementation, and the criticisms that are directed to these laws when applied, she addressed some laws related to women issues.<\/div>\n<div dir=\"ltr\"><\/div>\n<div dir=\"ltr\">Our colleague, Perwin Abdel Fattah, began her speech by thanking the chairman of the legislative council for participating in this dialogue and stressed on the following:<\/div>\n<div dir=\"ltr\"><\/div>\n<blockquote dir=\"ltr\">\n<div>Our legal observations as a human rights institution defending the right to freedom of association in accordance with international human rights law, and our main objective of this legal review is to reach a comprehensive, modern, and just law that regulates the work of associations and civil society organisations in areas controlled by ASANS and Syrian Democratic Force (SDF) supported by supported by the International Coalition against ISIL, and to ensure that the law is compatible with international human rights standards and in accordance with article 20 of the Universal Declaration of Human Rights; article 22 of the International Covenant on Civil and Political Rights; the Freedom of Association and Protection of the Right to Organize Convention; article 5 of the Declaration issued by the General Assembly of the United Nations (Declaration on the Right and Responsibility of Individuals, Groups and Organs of Society to Promote and Protect Universally Recognized Human Rights and Fundamental Freedoms) which is frequently abbreviated to \u201cThe Declaration on human rights defenders\u201d, which are the same principles and norms protected by the regional charters for the protection for human rights.<\/div>\n<\/blockquote>\n<div dir=\"ltr\"><\/div>\n<div dir=\"ltr\">Ms. Perwin presented a policy paper prepared by FFHR on ADANS\u2019s law regulating the work of associations, organisations, and humanitarian institutions issued by Decree No. 3 of 2017. She talked about the reality of civil society organizations in the region and the pressure exerted by Turkey on the region by preventing the international organisation, operating in Turkey, from providing support for civil work in the region and said:<\/div>\n<div dir=\"ltr\"><\/div>\n<blockquote dir=\"ltr\">\n<div>With\u00a0 the dramatic changes that took place in Syria after the year\u00a0 2011\u00a0 and\u00a0 the\u00a0 control\u00a0 of\u00a0 the\u00a0 Syrian\u00a0 Kurds over their areas,\u00a0 the status of clandestine civil society has changed to the\u00a0 public\u00a0 and\u00a0 the\u00a0 number of organizations has increased significantly in\u00a0 2015\u00a0 to\u00a0 more\u00a0 than 150 local organizations and different orientations,\u00a0 interests and competencies. Has suffered major\u00a0 pressures\u00a0 both\u00a0 internationally\u00a0 and\u00a0 \u00a0locally after\u00a0 2015, Turkey, which has\u00a0 the largest number of Syrian refugees, is considered the international and domestic humanitarian and civilian\u00a0 stronghold\u00a0 of the Syrians within Turkey\u00a0 and Syria. As a result of the military conflict between Turkey and the Kurds, Turkey has been accused of the self-governing authority of the Democratic\u00a0 Union\u00a0 \u00a0Party (PYD) Part of the PKK, a terrorist group in Turkey.The Turkish\u00a0 authorities\u00a0 prevented all organizations on their territory from providing all forms of support and funding to the\u00a0 organizations\u00a0 working in the area of control of the self-democratic administration. This\u00a0 was\u00a0 done\u00a0 concurrently\u00a0 with\u00a0 the European consensus with\u00a0 this trend.\u00a0 Turkey\u00a0 regards\u00a0 as\u00a0 a strategic ally of the Europeans.\u00a0 This has prevented\u00a0 the Syrian regime from any international organizations\u00a0 operating\u00a0 in its areas of control to deal in any way with the\u00a0 authority\u00a0 of\u00a0 \u00a0democratic self-management\u00a0 and the decline of civil work largely after these pressures.<\/div>\n<\/blockquote>\n<div dir=\"ltr\"><img fetchpriority=\"high\" decoding=\"async\" class=\"wp-image-6575 size-large alignright\" src=\"https:\/\/fraternity-sy.org\/wp-content\/uploads\/eed1-1-1024x683.jpg\" alt=\"\" width=\"1024\" height=\"683\" srcset=\"https:\/\/fraternity-sy.org\/wp-content\/uploads\/eed1-1-1024x683.jpg 1024w, https:\/\/fraternity-sy.org\/wp-content\/uploads\/eed1-1-300x200.jpg 300w, https:\/\/fraternity-sy.org\/wp-content\/uploads\/eed1-1-768x512.jpg 768w, https:\/\/fraternity-sy.org\/wp-content\/uploads\/eed1-1-1536x1024.jpg 1536w, https:\/\/fraternity-sy.org\/wp-content\/uploads\/eed1-1-2048x1365.jpg 2048w, https:\/\/fraternity-sy.org\/wp-content\/uploads\/eed1-1-370x247.jpg 370w, https:\/\/fraternity-sy.org\/wp-content\/uploads\/eed1-1-1410x940.jpg 1410w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><\/div>\n<div dir=\"ltr\"><\/div>\n<div dir=\"ltr\">She discussed at length the computability of the law with the international and regional standards of the right to freedom of association where she talked about the legal reservation of the articles of the law in the following:<\/div>\n<div dir=\"ltr\">\n<div><\/div>\n<div>\u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u2013 The contradiction of the law with the Charter of the Social Contract<\/div>\n<div>\u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u2013 The restrictions on registration and licensing \u201cExtended bureaucracy\u201d:<\/div>\n<div>\u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u2013 Restricting terms for founding members<\/div>\n<div>\u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u2013 Tightening the objectives of organizations<\/div>\n<div>\u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u2013 License withdrawals<\/div>\n<div>\u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u2013 Appeal against the decision of refusing the license<\/div>\n<div>\u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u2013 Follow up the activities of organizations and associations<\/div>\n<div>\u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u2013 Restrictions on the freedom of movement of associations and civil society organizations<\/div>\n<div>\u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u2013 The coordination, handling, and integration with the competent authorities<\/div>\n<div><\/div>\n<div><\/div>\n<div>She submitted the policy paper to the chairman of the Legislative Council which included recommendations and demands to amend the current law to ensure its computability with international human rights law, which will soon be published.<\/div>\n<div><\/div>\n<div>This activity was organised by FFHR within the framework of promoting political participation and democracy and defending the interests of civil society organizations by harmonizing domestic legislation with international human rights law.<\/div>\n<div><\/div>\n<\/div>","protected":false},"excerpt":{"rendered":"<p>The legislative council of the Autonomous Democratic Administration of Northern Syria (ADANS) in dialogue with our colleagues on legislation and the associations\u2019 law.
