The right to peaceful assembly is considered a positive aspect of a democratic society, because this right is closely linked to other political rights, such as the right to freedom of opinion and expression, the right to belong to associations, and the right to participate in the management of public affairs. International human rights law has recognized the right to peaceful assembly, as a recognized right, emphasizing the prohibition of restricting it with any restrictions except those imposed in accordance with the law. The right to peaceful assembly and not being restricted is also considered a civilizational aspect and an essential characteristic of democratic societies.<\/p>\n

In its strategic endeavor, which the Fraternity Foundation for Human Rights-FFHR began in 2013 to promote and protect human rights in Syria, and in continuation of its strategic plan for the year 2018, to focus and specialize in seeking to protect and enhance the right to freedom of peaceful assembly and association, and what it has implemented during the past years within the framework of the right to freedom of association, and at the beginning of this year and the start By working on the right to freedom of peaceful assembly by designing a training guide on international standards for this right and holding awareness-raising training workshops on its content, the Fraterniti Foundation for Human Rights issues a legal policy paper critical of the law regulating the right to demonstrate in Syria, entitled The Law to Suppress Demonstration in Syria. The paper prepared by the Legal Support Unit aims to In cooperation with female and Syrian lawyers, lawyers from Syria and Egypt analyze the legal implications of Legislative Decree No. 54 of 2011, the executive instructions issued by the Ministry of the Interior of the Syrian government, Legislative Decree No. 9 of 2012 regarding demonstrators, and the articles related to them in the Penal Code, and the extent of their violations of international standards for the right to freedom of demonstration, which resulted in damages. The right of Syrian men and women to exercise this right and the resulting victims of hundreds of thousands of male and female detainees who were forcibly disappeared and lost their lives under torture in Syrian prisons and detention centers and the resulting bloody war that has been going on for more than a decade are incalculable.<\/p>\n

In its recommendations in this policy paper, the Fraternity Foundation for Human Rights-FFHR confirms that the only solution to the legislative deficiency in the law regulating the right to demonstrate, and the legislation related to it (Legislative Decree No. 9 of 2012 regarding demonstrators – regarding the adoption of the text of Articles 335 and 336 of the Penal Code) is to confront the law. By abolishing it, not amending it or introducing improvements to it, because implementing it in its current form has led to prisons being filled with hundreds, if not thousands, of victims of exercising the right to peaceful assembly. Civil society organizations must fulfill their professional and legal role and responsibility towards Syrian society, by launching an advocacy campaign \u201cto abolish the law\u201d and demanding that the legislative institution work immediately to prepare a draft law on regulating the right to freedom of peaceful assembly that is compatible with international standards for the right to peaceful assembly. Syria’s legal commitment to its duties under the International Covenant on Civil and Political Rights is taken into account. Guided by international human rights conventions, the comments of the Human Rights Committee, and international best practices in ensuring the enjoyment of the right to peaceful assembly. In particular, the guidelines issued by the Office for Democratic Institutions and Human Rights (ODIHR) of the Organization for Security and Cooperation in Europe (OSCE)<\/p>\n

In preparing the new law, the guidance of General Comment No. (37) of 2020 on the right to freedom of peaceful assembly was taken into account, which refers to four very important topics for strengthening the right to peaceful assembly, which are:<\/p>\n

First: The scope of the right to peaceful assembly.<\/p>\n

Second: The state\u2019s commitment to respect the right to peaceful assembly.<\/p>\n

Third: Duties and powers of law enforcement agencies during peaceful gatherings.<\/p>\n

Fourth: Limits of the use of armed force by law enforcement forces.<\/p>\n
