This report is based on the accumulated experience of the Fraternity Foundation for Human Rights since its establishment in 2013. The Fraternity Foundation for Human Rights started to develop a Syrian National Index in 2022 to measure the state of the right to associate in Syria, after having focused since 2018 on a specialised field in the promotion and protection of the right to peaceful assembly and association, where the “Awareness Unit of the Fraternity Foundation for Human Rights” organized training workshops on international standards on the right to association for more than 200 civil society organisations in Syria

During the period 2018-2022, the Legal Support Unit of the Fraternity Foundation for Human Rights conducted opinion polls among nearly 300 civil society organisations in Syria and documented a number of violations committed by the parties to the Syrian conflict against civil society organizations, culminating in four reports. These reports were published during the year 2022, successively for each area of control.

Our organization conducted a legal analysis of the legislative and legal environment regulating the association sector in Syria through specialized legal studies supervised by a human rights lawyer from the Republic of Egypt.

Our foundation continued its close communication with Syrian civil society organizations in all four areas of control. During this communication, it collected documented information about the obstacles to their work and its recommendations for developing their capabilities to enjoy and exercise the right to form associations. At the end of the year 2022, the Fraternity Foundation issued its six basic indicators to measure the state of the right to form associations in Syria. .
In order to ensure more accurate results, the Legal Support Unit of the Fraternity Foundation for Human Rights developed indicator forms based on international standards on the right to freedom of association and the recommendations of the Special Rapporteurs on this right. To complete these forms, we relied mainly on field interviews with 148 Syrian civil society organizations,

 

أصدرت مؤسسة فراترنيتي لحقوق الإنسان مساء اليوم الإثنين 4 من أيلول تقريرها الخاص بحالة حق تكوين الجمعيات في سوريا لعام 2022 والذي يقيس درجة مؤشر حالة الحق في المناطق السورية الأربعة ويصدر هذا التقرير بناء على الخبرات المتراكمة لدى مؤسسة فراترنيتي لحقوق الإنسان منذ تأسيسها في العام 2013 حيث كانت قد بدأت مؤسسة فراترنيتي لحقوق الإنسان بتطوير مؤشر وطني سوري عام 2022، لقياس حالة الحق في تكوين الجمعيات في سوريا بعد تركيزها منذ عام 2018 على مجال تخصصي في تعزيز وحماية الحق في التجمع السلمي وتكوين الجمعيات،

 

ويأتي هذا التقرير كأول تقرير مؤشرات قياس حالة حق في سوريا ولأول مرة في سوريا قال ميرآل بروردا المدير التنفيذي لمؤسسة فراترنيتي لحقوق الإنسان أن :

 

” التقارير التوثيقية التي أصدرناها خلال السنوات الماضية حول انتهاكات سلطات الأمر الواقع لحق السوريات والسوريين في تمتعهم وممارستهم لحق حرية تكوين الجمعيات كانت البوصلة لتحركنا الدائم والحثيث للسعي من أجل حماية المنظمات السورية الزميلة في كل مناطق السيطرة المختلفة وكان اهتمامنا القانوني بإيجاد بيئة قانونية وتشريعية تتلاءم مع المعايير العالمية لهذا الحق أساساً لإصدار هذا التقرير”

 

 

 

جاء التقرير المكون من 32 صفحة تفصيلياً لواقع حالة الحق في حرية تكوين الجمعيات في سوريا يقيس قدر الممكن درجة تمتع الجمعيات السورية والسوريات والسوريين أجمالاً بهذا الحق ومدى توفير سلطات الأمر الواقع السورية هذا الحق للسوريات والسوريين.

 

ويظهر التقرير أن تصدر الحكومة السورية قائمة القمع الممنهج ضد حق حرية تكوين الجمعيات بـ10.3 نقطة على المقياس العام وتم تصنيف حالة الحق في تكوين الجمعيات في منطقة سيطرة الحكومة السورية بدرجة “غير حر” تلتها هيئة تحرير الشام التي تسيطر على منطقة شمال غرب سوريا بشكل أساس منطقة إدلب وريفها ب13.08 نقطة وتم تصنيفها أيضاً بدرجة ” غير حر ” تلتها منطقة سيطرة المعارضة السورية التي تخضع بشكل أساس لسيطرة الحكومة التركية ب52.5 نقطة وصنفت حالة الحق فيها بدرجة “مقيد جزئياً” فيما كانت منطقة سيطرة الإدارة الذاتية لشمال وشرق سوريا الأفضل بين مرتكبي القمع ضد حق حرية تكوين الجمعيات ب58.6 نقطة وتم تصنيف حالة الحق في هذه المنطقة بدرجة “مقيد جزئياً ”

 

واختتم التقرير بجملة من التوصيات إلى سلطات الأمر الواقع والمجتمع المدني السوري ومجلس حقوق الإنسان ومكتب المبعوث الخاص إلى سوريا.

 

أبرزها توصية المقرر الخاص المعني بحق حرية تكوين الجمعيات في سوريا لإصدار تقرير أممي حول حالة هذا الحق في سوريا.
